RELEASE: Buckeye State Blog Condemns NRSC's Improper Use of Video
The Buckeye State Blog was shocked to learn yesterday that the National Republican Senatorial Committee attack ad titled “Job Czar Lee Fisher is Wrong for Ohio” made heavy and unpermitted use of video shot by and for the Buckeye State Blog early last year.
The portions of the ad which depict Senate Candidate Lee Fisher speaking were taken from the video “BSB Exclusive Interview with Lt. Gov. Lee Fisher”, originally uploaded by Buckeye State Blog author Nick DeCenzo on March 4, 2009.
“We are deeply disappointed that the NRSC not only violated our copyright, but that they used the candidate’s remarks out of any reasonable context” said Buckeye State Blog Editor David Potts.
The Buckeye State Blog publishes content under a Creative Commons Attribution-NonCommercial-NoDerivs 2.5 License. As the NRSC web ad is a derivative work and does not give proper attribution to the Buckeye State Blog, we’ve requested that YouTube remove the video for copyright infringement.
The Buckeye State Blog is also trying to confirm if the still image depicting Senate Candidate Lee Fisher shirtless, taken from Jason Fisher’s movie “Swing State”, was also used without permission.

...of both BSB and Swing State videos. There may be a way to file a complaint with the Ohio or Federal Elections Commission(s). Not sure who has standing-- BSB or Fisher campaign, but a good elections lawyer would know. Also, can't imagine Jason Fisher gave permission for use of photo to the GOP. If the ad hits TV or cable, the Fisher campaign should go after the OEC and the TV stations, cable companies.
