UPDATE: OH Sen-24: Gary Kucinich Picked Over Rosemary Palmer

I wish I could say I was shocked by this, but the Executive Committee has picked Gary Kucinich over Rosemary Palmer to be the Democratic candidate for the 24th Senate district.

I really hope I'm wrong about this, but I feel like this district will be a complete write-off before too long.

UPDATE: Last night, Nick attended the CCDP Executive Committee meeting which was held at the Independence Civic Center. He reports that Cuy Co Dem Chair Jimmy Dimora began talking about Rosemary's residency issue; then had the CCDP's legal counsel speak at length about his opinion before giving Rosemary a chance to retort.

The crux of why they chose Kucinich is that an article in the Ohio Constitution requires senators and representatives to reside in the district for 1 year prior to the election. Apparently the Palmer's have two homes: one in Cleveland and one in Bay Village which they have recently acquired. Rosemary voted in the March primary in Cleveland Ward 15 which is not in the 24th District, so the CCDP legal counsel believes that she would be disqualified from running and that would allow GOPer Thomas Patton to run unopposed. 

Palmer's lawyer stated that because the constitution requires senators and reps to be residents and not electors of the distrct for 1 year, than Rosemary should be fine. He was backed up by Don McTigue, who's written opinion he had with him. However, the CCDP Exec Cmte chose to follow Chairman Dimora's lead and take the safe route by nominating Kucinich. He has not been campaigning and will get absolutely trounced in this GOP-leaning district because of his last name if nothing else, so why is he better than a candidate who has been campaigning but may be disqualified? We're not sure.

Does or can anyone obtain a copy of the Cuyahoga County Democratic Party's legal counsel's opinion?  Did he receive any input from Secretary of State Brunner's office in that opinion?

And lastly, am I the only one who finds it odd that the County Party has a legal counsel?

I would expect that of the ODP, but not a county party.

He's better than her only because if she gets disqualified before the election, the Democrats have no one and the Republicans are guaranteed a win. This way, they may get defeated, but it's not a guarantee. I would have loved for her to be the candidate, but they're being smart about this. And modern, it's not surprising. I'd be more surprised if the individual counties didn't have legal counsel. I doubt they're paid much - if anything, depending on the county. But, there's prestige and networking and marketing that offsets any discount they give the party...
